[1] Both the applicant (“Jeffrey”) and the respondent (“McNab”) request their costs of the motions heard on September 24, 2018. In their written submissions both Jeffrey and McNab claim to be the more reasonable and the more successful party.
[2] In my opinion, neither Jeffrey nor McNab can truly claim to be the successful party on these motions. Six issues were addressed in my written decision and success was obviously divided. Further, the practice of dissecting each issue to decide which party took the more reasonable position should not be encouraged by the court.
[3] Given the mixed success, there will be no costs to either party.
