COSTS ENDORSEMENT

[1] I have reviewed the submissions of both parties with respect to costs and have considered the factors set out in the Rules and in the case of Boucher v. Public Accountants Council for the Province of Ontario (2004), 71 O.R. (3d) 291 (C.A.).

[2] The Plaintiff was entirely successful on the motion. I accept the argument of the Defendant that its costs should be awarded to be paid by Mr. Bouragba.

[3] Mr. Bouragba made no submissions, other than his allegations that the endorsement for the motion was wrong, on any relevant factor for the Court to consider with respect to costs. The Plaintiff, on the other hand, made detailed submissions which I find reasonable and I agree with. I therefore award costs in the amount of $10,000 to be paid by Mr. Bouragba to the Plaintiff.
