Reasons for Decision - Addendum

[1] This is an addendum to my Reasons for Decision released on August 23, 2018. See Trez Capital Limited Partnership v. Ontario International College Inc., 2018 ONSC 4978.

[2] In those Reasons for Decision, I granted the Plaintiff a summary judgment in respect of a guarantee signed by the Defendant in respect of a mortgage given by 2481043 Ontario Inc.

[3] In paragraphs 33 and 49 of the Reasons, I misstated the amount owning on the mortgage as of August 16, 2018. The correct amount owing on the mortgage as of August 16, 2018 is $2,841,580.55. The judgment should be drafted accordingly.

[4] In my Reasons for Decision, I did not expressly address the matter of the post-judgment interest rate.

[5] For clarity, I now indicate that post-judgment interest should accrue at the interest rate set out in the mortgage. The judgment should be drafted accordingly.

[6] The Defendant agrees that as of August 16, 2018 the correct amount of the mortgage debt is $2,841,580.55 and takes no position with respect to the post-judgment interest rate.
