Court File and Parties
COURT FILE NO.: 18-CV-574948 DATE: 20180711 SUPERIOR COURT OF JUSTICE - ONTARIO
RE: motion for interlocutory injunction
COUNSEL: Gary M. Caplan for the Plaintiffs Nadire Atas self-represented
HEARD: July 11, 2018, in Chambers
BEFORE: D.L. Corbett J.
Endorsement
[1] I have today received correspondence from Ms Atas, not setting out her position respecting the motion for an interlocutory injunction, but in respect to three other matters:
(1) Ms Atas asks that I release my costs decision on the s.140 application so that she may perfect her appeal by July 31, 2018. I indicated at the last case conference that I would release the costs endorsement this summer. The court is currently on vacation and will not likely be releasing the costs decision before the end of July. It is not for this court to manage process in the Court of Appeal, of course, but for Ms Atas’ benefit I note that she can perfect her appeal on the basis of the record as it currently exists.
(2) Ms Atas asks that I sign the order setting aside the noting in default in Stancer Gossin Rose v. Atas. That order was signed shortly after the last case conference. The parties may confer with my assistant to track it down or obtain copies of the signed order if it has not yet been distributed or if not all parties have received a copy. If there are any difficulties with it, they can be addressed at the next case conference.
(3) Ms Atas tells me that she has been notified by counsel that the Chahals have disposed of some of her property from 298 St. George St, including a vehicle. If there are issues respecting this personal property, they are matters to be raised at the next case conference and not in correspondence to the court.
