SUPERIOR COURT OF JUSTICE - ONTARIO
RE: Numerous Proceedings Involving Nadire Atas
BEFORE: D.L. Corbett J.
COUNSEL: Christina J. Wallis, for Peoples Trust Gary M. Caplan, for Applicants other than Peoples Trust and the Chahals Yoginder Gulia, for the Chahals Nadire Atas, self-represented and for 626381 Ontario Limited
ENDORSEMENT
[1] I have today received a communication from Mr Caplan requesting an urgent case conference. This conference shall take place at 9 am, Monday April 9, 2018. It is mandatory that counsel and Ms Atas attend the conference, on time, which will be conducted at 361 University Avenue, Toronto.
[2] A fresh proceeding has been commenced against Ms Atas by Dr Joseph Caplan and others (Court File CV-18-574948) alleging, among other things, breach of the Current Injunction order, and civil and criminal harassment, arising out of what is characterized by counsel as a “fresh internet attack [that] is shocking in its scope, intensity and viciousness.” Counsel requests to proceed without notice to Ms Atas. I decline to do that, and for that reason issue this endorsement today. However, if Ms Atas fails to appear on Monday April 9^th^, as directed, this court may proceed to grant interim relief, or to give directions in respect to these matters, in her absence.
[3] Counsel is directed to provide Ms Atas with a copy of everything delivered to me by courier as soon as possible, by email.
[4] I note that in the materials, it is requested that this court refer the matters that are the subject matter of the fresh proceedings to the Crown and/or to police. In my view it is for the parties and not the court to take a matter to police or the Crown, if they wish to do so, and the parties may take this step immediately, without further direction from this court, if that is their wish.
D.L. Corbett J.
