Costs ENDORSEMENT

[1] The Respondent, Mrs. Leedy was successful on her motion for temporary spousal support. The Court ordered temporary spousal support in the sum of $1,284 per month and ordered that the matrimonial home be listed for sale. The Respondent had offered to accept a lower amount in a Settlement Offer dated November 17, 2016.

[2] The Applicant was seeking more generous access, by way of cross relief, but argument on that issue did not proceed because the report of th OCL was not yet available to the Court. The Applicant had been refusing to pay any temporary spousal support until the Respondent agreed to increased access. That was an unwise approach as spousal support and access are entirely separate issues.

[3] Having considered the costs submissions filed by each party, as well as the party’s financial circumstances, I exercise my discretion to fix the costs in the sum of $5,000 for fees plus applicable HST and disbursements in the sum of $300 payable by the Applicant, Mr. Leedy to the Respondent, Mrs. Leedy within 30 days of the release of this endorsement.
