Endorsement

[1] The Respondent moved unsuccessfully for an order varying child support and terms of residence. The Applicant moved successfully for an order re-establishing the regime of the separation agreement. See 2017 ONSC 6596. The Applicant now asks for costs.

[2] The Applicant offered to settle without costs for exactly what she got. She should be substantially indemnified. Given the modest amount charged, I think the Applicant should get a close approximation of the actual bill, which was $3,105.81.

[3] I fix costs at $3,000 and order the Respondent to pay them to the Applicant forthwith. This amount was expended for child support and shall be enforced as such. A support deduction order will issue.
