1The Respondent moved unsuccessfully for an order varying child support and terms of residence. The Applicant moved successfully for an order re-establishing the regime of the separation agreement. See 2017 ONSC 6596. The Applicant now asks for costs.
2The Applicant offered to settle without costs for exactly what she got. She should be substantially indemnified. Given the modest amount charged, I think the Applicant should get a close approximation of the actual bill, which was $3,105.81.
3I fix costs at $3,000 and order the Respondent to pay them to the Applicant forthwith. This amount was expended for child support and shall be enforced as such. A support deduction order will issue.
