ENDORSEMENT REGARDING TRIAL COSTS SUBMISSIONS

[1] Following the release of my trial decision, the parties delivered written costs submissions. In costs submissions dated September 12, 2017, filed on behalf of the applicant, her counsel asserts that the offers to settle dated April 21, 2016 and May 13, 2016, referred to in the respondent’s costs submissions, were withdrawn 12 days prior to trial. Mr. Rappaport also asserts that the respondent’s offers to settle were not “received” by counsel for the applicant until September 6, 2017, and only because they were appended to the respondent’s costs submissions.

[2] So that my decision on costs gives proper consideration to any offers to settle, I direct that within seven days of the date of this endorsement, the respondent serve and file proof of service of any and all offers to settle upon which the respondent seeks to rely and which are referred to in his costs submissions dated September 6, 2017. The respondent shall also serve and file evidence that shows whether and when any such offer was withdrawn.
