ENDORSEMENT

[1] In my previous endorsement [2017 ONSC 4018] I granted the Respondent’s motion for an extension of time to file a sworn financial statement on the condition that he pay costs to the Applicant in an amount and within a time to be set by me after considering brief written submissions. I made this order not on the basis of unreasonable conduct or bad faith under Rule 24, but in the exercise of my jurisdiction to award costs against a successful party as a term of indulgence.

[2] Having received written submissions from both parties, I fix the costs of this motion at $1,500 and order the Respondent to pay them forthwith.
