[1] On July 24, 2017 I received a letter from counsel for the applicant. In it, Mr. Rappaport advised that the respondent father “will be starting a secondment in Basel, Switzerland, in September 2017 and will no longer be residing in Canada. The secondment in Basel from the Bank of Canada is for a three-year period.”
[2] On July 26, 2017 I received a letter from counsel for the respondent. Ms. Mayer’s letter reads, in part:
I am writing in response to Mr. Rappaport’s correspondence dated July 24, 2017. Mr. Rappaport’s letter is not only improper but riddled with inaccurate information.
Following the trial, Dr. Rivadeneyra has continued to explore options of employment abroad keeping in mind the risk that Your Honour could allow Ms. Uriu to relocate to Vienna, Austria with Luca. Dr. Rivadeneyra believes that having an option to relocate closer to Luca would be in Luca’s best interest should this Honourable Court allow the relocation.
[3] Mr. Rappaport requests the opportunity to make additional submissions in writing before the trial decision is rendered. Ms. Mayer takes the position that it was improper for Mr. Rappaport to write to me after the trial but before I had rendered my decision. She expresses the view that my decision will resolve most of the live issues between the parties.
[4] When I received this correspondence from counsel, I was in the process of completing my Reasons for Decision. I expect that my decision will be released by Tuesday, August 8, 2017. It will be based on the sworn evidence received at trial. I will not take the recent correspondence into consideration.
