Supplementary Reasons to Decision Released on May 19, 2017
RAY, J
[1] These supplementary reasons to my decision in 2017 ONSC 3134 are required because after deciding the issues, I had asked the parties for written submissions concerning the form of the judgement which may have required they obtain accounting advice.
[2] After releasing my decision, I was advised that the respondent had died. I was asked by the applicant to extend the time for written submissions by 45 days in order for the respondent’s estate to become involved, and for the applicant to obtain an order to continue the proceeding against the estate.
[3] The time referenced in paragraph 16(c) of my decision is extended a further 45 days.
[4] I consider the issues raised in paragraph 16 of my decision, which were intended to be dealt with by the parties in writing, relate to the implementation and execution concerning the decisions on the various issues to be incorporated into the formal judgment. In the event I am unavailable to settle the form of the judgement, I do not consider I am seized, and another judge can be assigned to complete the final judgment—or the Registrar if the parties as reconstituted, agree.
