COSTS ENDORSEMENT
[1] The responding party plaintiffs were wholly successful in this summary judgment motion brought by the moving party defendants, S, Jeyakumar and Financialinx Corp., as found in my Endorsement released May 9, 2017. In general, costs are awarded to the successful litigant and are intended to indemnify the successful party for a portion of its costs incurred.
[2] At the end of the motion, both parties provided their bills of costs. I have reviewed the costs submissions of the parties. Both parties’ bills of costs were almost the same.
[3] As the successful party, I am satisfied that the responding party plaintiffs are entitled to their costs. I have reviewed their costs and find them to be reasonable and proportionate. In awarding costs, I have also taken into account the factors set forth at Rule 57.01 of the Rules of Civil Procedure.
[4] I award the responding party plaintiffs their costs on a partial indemnity basis in the amount of $7,166.78, all inclusive, payable forthwith by the moving party defendants, Mr. Jeyakumar and Financialinx Corp.
