Endorsement
[1] A motion was made by the Applicant for various relief. The Court only dealt with the issue and the relief sought in relation to counselling.
[2] On consent, the parties agreed that the Respondent (“Father”) would use his best efforts to ensure that Katelyn Dessureault, born July 31, 1999, attends counselling as set out below.
[3] The children Megan Dessureault, born November 7, 2001, and Benjamin Dessureault, born September 24, 2004, shall attend counselling with a counsellor to address issues relating to the coping with the separation and reunification with the Applicant (“Mother”).
[4] Both parties shall cooperate with the intake process as directed by the counsellor including signing releases of information to speak with professionals who may assist with the intake process.
[5] The counsellor may communicate with any medical, mental health, education or third party professionals who are treating, working with, or have treated or worked with either party or the children as needed to effectuate as successful intake process.
[6] Third party professionals who have privileged information regarding the parties and/or the children shall be authorized to speak and share such information with the counselor. Any such information shall remain privileged and may not be disclosed by the counsellor, in his or her discretion, except to a court of competent jurisdiction if it is necessary to explain the actions or recommendations of the counsellor or as may be authorized by further order of such court, or as may be agreed to by the parties.
[7] The parties, and, to extent that they can be encouraged to do so, the children, will fully comply with the intake process as directed by the counsellor, once accepted.
[8] The parties shall have an affirmative duty to fully participate in all aspects of the counselling process as directed by the counsellor, including the development of an after-care program with the counsellor.
[9] The parties may meet with the counsellor.
[10] The parties shall follow all after-care plans that are proposed by the counsellor. The parties shall engage the services of a mutually agreed upon mediator/arbitrator or parenting coordinator to resolve any disputes as to the interpretation and implementation of any after-care plan proposed by the counsellor. The parties shall provide the mediator/arbitrator or parenting coordinator with copies of any and all after-care plans.
[11] The parties shall sign any and all releases necessary so that the information can be communicated between the counsellor and professionals who may provide after-care services for the family.
[12] The parties shall employ any available plan of health insurance available to defray the costs of the counsellor and any after-care services. If the uninsured costs of the counsellor exceed $2,000 in aggregate, the parenting coordinator shall decide the issue of the necessity of any additional counselling and how such costs will be shared between the parties.
[13] Each party shall pay for one half of the costs of the services provided by the counsellor up to an amount of $2,000 in total, after the use of the insurance plan.
[14] A list of three counsellors located in the west-end of Ottawa shall be provided by the Applicant’s counsel to the Respondent within seven days. The Respondent shall choose one of those three counsellors within three days. Counselling shall begin as soon as possible. The Mother’s counsel shall advise the Court of the name of the counsellor chosen in writing within three days thereafter.
[15] The costs of today are reserved to the judge finally dealing with the matter.
