Corrigendum to Reasons for Mid-Trial Ruling – Voir Dire Regarding Admissibility of Composite Video

[1] At trial, the evidence of Mr. Michael Plaxton is that he is a certified forensic video analyst. He works fulltime for the Hamilton Police Service and analyzes videos for the police. He however does part time work outside of regular hours in a private capacity.
[2] In the mid-trial ruling, I referred to Mr. Plaxton as Officer Plaxton. While Mr. Plaxton may well be a peace officer as defined by s. 2 of the Criminal Code, he considers himself a civilian and accordingly, at trial, I refer to him as Mr. Plaxton, not Officer Plaxton.
[3] Accordingly, “Officer” Plaxton in the mid-trial ruling should be changed to “Mr.” Plaxton. This change does not otherwise change or affect the mid-trial ruling issued on March 16, 2017.
