Endorsement Regarding Costs
Facts
[1] The Defendants Egalite and Collings and Langlois were completely successful on their motions to dismiss the plaintiff’s actions against them.
[2] Egalite has incurred partial indemnity costs of $6,570.00 inclusive of disbursements and HST, but only seeks costs of $3,000.00 all inclusive.
[3] Collings’s and Langlois’s all-inclusive partial indemnity costs total $5,464.00 and $3,903.00 respectively for the action and this motion. They seek $2,500.00 each inclusive of disbursements and HST.
[4] I find that the Defendants’ positions are both very reasonable given their complete success and the lack of any legal basis for the claim against the three lawyers in the first place.
Disposition
[5] The Plaintiffs are ordered to pay costs of $3,000.00 inclusive of disbursements and HST to Egalite and $2,500.00, all inclusive, to each of Collings and Langlois.
