ENDORSEMENT
[1] My endorsement will be brief. This matter proceeded as an undefended claim. The Plaintiff has satisfied me that he has suffered damages as a result of the actions of the Defendant.
[2] The Defendant breached its contract with the Plaintiff and has been unjustly enriched as a result.
[3] Further, the Defendant has improperly used the Plaintiff’s trade name (Kerkuk Café) and the good will associated with it.
[4] The Plaintiff shall forthwith provide the court for its review a draft judgment. The judgment should summarize the losses and damages sustained and provide totals for each category.
[5] Costs are awarded to the Plaintiff on a substantial indemnity basis fixed in the amount of $25,000.00 inclusive of disbursements and HST. This provision should also be included in the draft judgment.
