[1] By Endorsement dated August 2, 2016, I dismissed the Applicant’s motion for leave to appeal to the Divisional Court from the order of Justice Kershman dated March 15, 2016.
[2] Justice Kershman concluded that there were great concerns with respect to the Applicant’s ability to conduct this matter as well as a related small claims court action. He accordingly ordered an assessment in accordance with s. 105 of the Courts of Justice Act, R.S.O. 1990, c. C. 43. That assessment was to be conducted by the assessor as defined by subsection 1(1) of the Substitute Decisions Act, 1992, S.O. 1992, c. 30. This assessor was to assess Ms. Sennek’s mental condition and to advise the Court with respect to Ms. Sennek’s ability to understand information relevant to making decisions in the within litigation in a related small claims court action as well as her ability to appreciate the reasonably foreseeable consequences of a decision or lack thereof in the within litigation in small claims court action.
[3] In paragraph 31, I invited brief submissions to costs. I have received those of the Respondent as well as their Bill of Costs. Nothing has been filed by the Applicant. Having regard to the unusual circumstances of this case, I believe that the issue of costs should be deferred until the results of the assessment ordered by Justice Kershman have been made available.
