COSTS ENDORSEMENT
[1] The respondent [moving party] was successful on a motion before me and December 3, 2016, which costs were reserved.
[2] As set out in my endorsement, there is a history of delay which is laid at the feet of the applicant and in addition there are previous findings that the applicant was in contempt of court.
[3] After reviewing the submissions of both parties, I am fixing costs at 70% of substantial indemnity costs and therefore, the applicant shall pay to the respondent costs fixed in the amount of $11,190.82.
[4] Under the circumstances, these costs shall be paid by the applicant personally and shall not come out of the estate.
