ENDORSEMENT
[1] This requisition was referred to me by the Registrar’s Office pursuant to rule 2.1 .01(6) of the Rules of Civil Procedure, R.R.O. 1990, Reg. 194, following receipt of a written request of the Defendants dated September 1, 2016. The Plaintiff was copied with that request.
[2] By Endorsement dated September 12, 2016, I directed the Registrar to give the Plaintiff notice that the Court was considering making the order requested. That notice (Form 2.1A) was mailed to the Plaintiff that same date. It advised the Plaintiff that he was to file a written submission, no more than 10 pages in length, responding to the notice in accordance with rule 2.1.01(3)(2). I also stayed the action pending the outcome of that written hearing. The Registrar was directed to accept no further filings in this action excepting only the Plaintiff’s written submissions.
[3] On the September 12, 2016, the Plaintiff filed a Fresh as Amended Statement of Claim which he then served on counsel for the Defendants. That Fresh as Amended Statement of Claim bears the same date as the original Statement of Claim, namely, May 16, 2016. No written submissions were received in response to the notice given.
[4] While the Fresh as Amended Statement of Claim is now 13 pages in length and pleads additional facts, all of the events complained of and all of the Defendants are residents of Bermuda and these Defendants include a Magistrate and a Supreme Court Judge of that country. The Notice to the Plaintiff raised this Court’s lack of any apparent jurisdiction over these claims. The Plaintiff has not responded to this critical issue with his amended pleading or in any other way.
[5] It is apparent that this action may be frivolous, vexatious, and an abuse of process of the Court, and resort to Rule 2.1 is appropriate. I therefore dismiss this action and direct the Registrar to provide a copy of this Endorsement by mail to the Plaintiff and the Defendants.
