Endorsement
[1] There is no doubt on the facts of this case that the applicant is entitled to spousal support. The only issue is the quantum of the support. Similarly the respondent has an obligation to pay child support in accordance with the guidelines.
[2] For many years the parties have jointly enjoyed substantial income, all of which was derived from the respondent’s various businesses and investment companies. Up to the time of separation the parties year after year split the business income that totaled well over $200,000 in certain years.
[3] The respondent now says his income is substantially lower. However his businesses are still operational and have substantial retained incomes available to them. The respondent is in full and sole control of all of these corporations.
[4] This is an interim support motion. It is impossible to go in any depth into the allegations. This will be for trial. At this stage, the Court is certainly not convinced that the respondent does not have substantial means to properly support his spouse and child. The needs of the child and spouse are real and can only be met by support from the respondent.
[5] I fix the husband’s yearly income, on a without prejudice basis, at $130,000. The respondent must pay child spousal of $1,781.00 per month and spousal support in the amount of $2,000.00 per month retroactive to April 1st, 2016.
[6] Temporary order to issue accordingly.
