ENDORSEMENT re: COSTS SUBMISSIONS

[1] By letter dated September 26, 2016, Sara Mahoney counsel for Paterson Group Inc. asked that her clients’ costs of the Damages Trial be reserved to be determined at the time of the Liability Trial. I made such an Order with respect to the Goodeve Manhire parties.
[2] As the plaintiffs’ action against Paterson Group Inc. was dismissed without costs prior to the Damages Trial, Paterson’s claim for its costs of the Damages Trial would be against Tega Homes Developments Inc., which kept Paterson in the action by way of its cross-claim. Tega is on notice of Paterson’s costs claim.
[3] Ms. Mahoney advises that Tega consents to this request, as it had done with respect to the request from the Goodeve Manhire parties. Accordingly, the determination of Paterson’s costs of the Damages Trial is reserved to be determined at the time of the Liability Trial.
