1The applicant was successful on his motion for interim exclusive possession of the matrimonial home. The respondent’s cross-motion for interim support was dismissed, without prejudice to her bringing a motion for support back on should there be a change in her employment status.
2The applicant was the successful party and is presumptively entitled to costs pursuant to r. 24(1) of the Family Law Rules. The presumption has not been displaced.
3The applicant seeks costs on a partial indemnity basis in the amount of $1,842.13 all inclusive. I do not find this amount to be unreasonable.
4The respondent shall pay costs to the applicant in the sum of $1,842.13. This amount is payable 30 days from the date hereof.
