Costs Endorsement

[1] The applicant was successful on his motion for interim exclusive possession of the matrimonial home. The respondent’s cross-motion for interim support was dismissed, without prejudice to her bringing a motion for support back on should there be a change in her employment status.

[2] The applicant was the successful party and is presumptively entitled to costs pursuant to r. 24(1) of the Family Law Rules. The presumption has not been displaced.

[3] The applicant seeks costs on a partial indemnity basis in the amount of $1,842.13 all inclusive. I do not find this amount to be unreasonable.

[4] The respondent shall pay costs to the applicant in the sum of $1,842.13. This amount is payable 30 days from the date hereof.
