Costs Endorsement

[1] Ms. Walts is entitled to costs in the motion to change. She was the successful party. Her offer delivered April 15, 2016 is very similar to the court ordered outcome, except for the order to share the further increase in the cost of life insurance, and the review being on his age 65, not hers.

[2] I find she is entitled to partial recovery costs to the date of the order, fixed at the high end of that scale and full costs thereafter.

[3] In reaching this conclusion, I also find that the Applicant was not unreasonable in bringing his motion having regard to the comments my judicial colleague made with respect to her ability to access her LIRA at age 55.

[4] For this reason I fix Mrs. Walts costs, all inclusive, including for costs submissions, at $13,250.00.
