[1] Each party seeks recovery of their costs for the motion heard on June 16, 2012. The Applicant sought an order seeking a change in the exchange time for their daughter Danielle. The Respondent sought leave to abridge the timelines for the service of an expert report before trial and to increase child support to $998 per month.
[2] I granted the relief sought by the Applicant and I dismissed the Respondent’s motion with respect to the expert’s report and ordered the Applicant to pay child support in the amount of $650 per month.
[3] The issue of the expert report did not take up a great deal of time. While I conclude that the Respondent was unreasonable on the exchange time issue, the Applicant should have recognized that an increase in child support was inevitable. I conclude that overall success on the motion was divided and I decline to make an order for costs in favour of either party.
