[1] Following a 2 day trial. I ruled that the separation agreement between the parties was valid and enforceable. The trial and this finding was following an order for the trial of an issue as part of the proceeding.
[2] I asked for costs submissions. The successful applicant, who was self-represented, appears to have misunderstood that the trial only determined an issue, and made submissions for indemnity for all of her costs for the action to date in the amount of $14,684.00. The respondent correctly pointed out that a more acceptable order for costs of just the trial would be in the order of $2582.00.
[3] There is no doubt that the applicant sustained other costs. She can seek those costs as part of the overall resolution of the proceeding.
[4] I accept that a proper award of costs to the applicant as identified in her submissions related only to the trial of the issue is $3,000 inclusive of HST, payable by the respondent within 90 days.
