[1] The Defendants were completely successful at the motion heard by me on April 28, 2016. The Plaintiff’s motion was dismissed in its entirety.
[2] I am satisfied that in these circumstances the Defendants are entitled to costs.
[3] The Plaintiff seeks costs in the total sum of $3,938.05. The Bill of Costs of the Defendants sets out the following:
Jesse R. Boyd: Call to the Bar 2012 Hourly rate - $141 / hour on partial indemnity scale Total hours 4.8 for pleadings, correspondence, preparation for hearing, attendance at hearing
Logan R. Schroeder: Call to the Bar 2012 Hourly rate: $141 / hour on partial indemnity scale Total hours 8.6 for pleadings, correspondence, preparation of responding material
Paralegal: 2.8 hours at 72.00 / hour for pleadings, correspondence
[4] The Bill of Costs did not include the time dockets. I cannot determine, therefore, whether there has been a duplication of time or why it was necessary for two counsel to be involved in this motion. The motion was not complicated nor did it consume much court time.
[5] The costs submissions of the Plaintiff is that she is agreeable to pay $2,500 in costs to the Defendants for the motion.
[6] I am satisfied that the amount proposed by the Plaintiff is reasonable in all of the circumstances.
[7] Order to issue that the Plaintiff pay to the Defendants their costs of the motion fixed in the sum of $2,500 all-inclusive within 30 days.
