Overview:
[1] The Court requested that a Case Conference be held on May 19, 2016 for the purpose of following up on matters which must be addressed in order for the parties to proceed to trial in September 2016.
[2] The main point of contention is the requirement for the parties to comply with paragraph 30(8) of Justice Blishen’s Endorsement dated February 23, 2016. The parties have been advised by the clinician, Chantal Bourgeois of her unavailability to provide an update to her previous assessment.
[3] The parties have consulted other social workers who require that a complete report be done, causing the parties to incur significant additional costs, while it is doubtful a new report can be completed in time for the trial.
[4] In a February 25, 2016 e-mail, Ms. Bourgeois provided the parties with a description of a limited scope update that could be done. While it may or may not be possible to prepare a written report in time for the trial, the proposed update would allow Ms. Bourgeois to give evidence at trial which will be of crucial assistance to the Court in making its final decision.
[5] I hereby direct the parties to provide Ms. Bourgeois with a copy of this Endorsement and that she be asked to provide the limited scope update contemplated In her February 25, 2016 e-mail, or such variation thereof, allowing her to provide an update to her assessment report.
[6] Should Ms. Bourgeois not be able to provide requested update or should she require additional time, the parties will schedule a further Case Conference before me on short notice to discuss next steps given that the trial dates are fast approaching.
[7] In addition, the parties are ordered to provide each other with updated financial statements thirty (30) days prior to the commencement of the trial and will include year to date income up to and including June 30, 2016.
[8] With respect to the new dentist for the children, the Applicant will provide the required information relative to the new dentist, along with a description of the services received by the children to date.
[9] Finally, on the issue of Mr. Beauchamp’s income, I am not prepared to order the production of documents relating to Mr. Beauchamp’s income without a proper motion being brought, however the information about his income may need to be provided as part of the Applicant’s Financial Statement.

NOTE REGARDING THE RECORD: The official record of a conference is the endorsement prepared by the presiding judge or master. Participants are advised that it is the policy of the Superior Court of Justice that discussions taking place at conferences are otherwise privileged and confidential. Although a reporter was present and the proceeding was recorded, such recordings at conferences are for use of the presiding judicial official, similar to his or her own notes. As such it is the policy of the court that transcripts are not available. Any request for a transcript or access to an audio recording must be made by motion on notice and will be granted only in unusual circumstances.
