Endorsement
[1] The plaintiff purports to sue for medical malpractice that caused the death of his wife, (he says).
[2] His “Statement of Claim” is over 400 pages long and is unintelligible. If someone has a right to sue for the negligence allegedly perpetrated on the deceased, it is far from clear that it is the plaintiff or that his pleading fairly does so.
[3] It appears that the action may be frivolous, vexatious or an abuse of process on its face. Mr. Rallis needs medical and legal help to determine if he can sue as he wishes and to learn how to do so.
[4] I therefore direct:
a. The Registrar to send a notice in Form 2.1A to the plaintiff;
b. This action is stayed under s.106 of the Courts of Justice Act, R.S.O. 1990, c.C.43, pending further order of the court;
c. The plaintiff may take no steps and may file no further materials other than up to 10 pages of submissions, if delivered in accordance with rule 2.1.01(3);
d. The Registrar shall send a copy of this endorsement to the plaintiff and counsel for the defendants.
