ENDORSEMENT regarding costs re-hearing
[1] This matter concerned a contract between an insurance network and a member broker. On July 2, 3013 I granted judgment to the Plaintiff, Prolink: Prolink Broker Network v. Jaitley, 2013 ONSC 4497, [2013] O.J. No. 3065. On October 3, 2013 I released my reasons for judgment in respect of damages: Prolink Broker Network v. Jaitley, 2013 ONSC 6253, [2013] O.J. No. 4542. On November 24, 315 the Divisional Court reversed my damages award: 2015 ONSC 6484, [2015] O.J. No. 6108 (Div.Ct.). The Divisional Court remitted the matter back to me to determine damages in accordance with the principles set out in its judgment.
[2] After consultation with counsel for the parties, a timetable was agreed upon. This endorsement memorializes the following schedule:
• The Plaintiff will have 60 days to deliver a valuation report to the Defendant.
• The Defendant will have 45 days to deliver a responding valuation report to the Plaintiff.
• The Plaintiff will then have 30 days to deliver a reply report to the Defendant, if it so chooses.
[3] Once reports are exchanged, the parties are to contact me through my assistant for a date for the damages re-hearing.
[4] The parties are encouraged to continue to engage in settlement discussions.
