SUPPLEMENTARY ENDORSEMENT re: COSTS
[1] In my endorsement released January 29, 2016, I invited written submissions from counsel on the issue of costs.
[2] The applicant was successful on his motion to sever the divorce. Counsel agree he is entitled to a cost award. The dispute is with quantum.
[3] The corollary issues are being addressed in the companion action, court file 117/15. Delay in addressing those issues, including disclosure and payment of the assessor’s retainer, unnecessarily complicated the within proceeding.
[4] In all of the circumstances, costs are awarded to the applicant, fixed in the amount of $1,500, inclusive of HST and disbursements, payable in any event of the cause upon resolution or determination of the issue in action 117/15.
