Addendum to Reasons on Bail Review
(R. v. Pelletier, 2016 ONSC 1487, March 1, 2016)
[1] Paragraph 41 of my reasons is amended on the consent of the Crown and Mr. Pelletier to provide for the terms of release as follows as per my order dated March 3, 2016:
UPON THE APPLICATION of the above named Applicant, and on reading the notice of application, the affidavit of the applicant, the affidavit of Timothy Ward, and the submissions of Counsel;
IT IS ORDERED THAT the said Applicant, upon entering into a recognizance in the amount of $50,000.00, with one named surety, Timothy Ward, and without deposit, be granted judicial interim release upon the following conditions:
Keep the peace and be of good behavior;
Reside with Timothy Ward (DOB May 17, 1967) at 103 Back Street Rd., Fort William First Nation, Ont., and be amenable to the rules and discipline of that residence;
Report in person to the Thunder Bay Police Station, 1200 Balmoral Street, Thunder Bay, Ontario, every Monday between 8:00 a.m. and 8:00 p.m. commencing on the first Monday following his release from custody with one piece of personal identification which includes a photo;
Be inside his place of residence at all times, and not away from his residence unless in the presence of his surety;
Remain within 200 km radius of the City of Thunder Bay, Ontario, save and except at scheduled appointments with Counsel;
Deposit with Constable Jeremy Pearson, or his designate, his passport, Nexus Card and/or Certificate of Canadian Citizenship within one week of his release from custody and not to apply for a replacement of the same;
Shall not consume or possess any non-medically prescribed drugs as set out in the Schedules to the Controlled Drugs and Substances Act or be in the possession of drug trafficking paraphernalia;
Shall not possess or use any pager, cellular telephone, Blackberry, iPhone, or other portable telecommunication device or internet access, or landline, save and except you may use a landline in the presence of your surety or in case of emergency or to contact your surety;
Except through Counsel, shall not associate or communicate, directly or indirectly, with the following persons: Travis Gordon, Robert Dennis Chiodo, Monica Pihlaja-Chiodo, John Harry Tsekouras, Julie Tsekouras, Elaine Tsekouras, Keith Ritchie, Frank Muzzi, Rosella Muzzi, Fortunato Colistro, Tori Colistro, Jason Stokaluk, Lonny Poulin, Laura Muzzi, Ben Tycholiz, Ryan Smith, Eugenio Caruso, Frank Magisano, Ashur Baijan, David Hui, Orasha Bailey, Tai Duc Ong, Vu Pham, Cathy Pham, Nhu Pham, Francesco Bennardo, Virgil Baya, Rony Sarkis, Tony Marino, George Dritsas, Cosmos Dritsas, Ken Poirier, Donald Minier, Everton Ennis, Shannon Bullard, Alain Gallant and “Harold Bramwell”;
Shall not possess any weapons as defined by the Criminal Code of Canada, including a firearm, crossbow, prohibited weapon, restricted weapon, prohibited device, ammunition or explosive substance;
Shall surrender any Possession or Possession Acquisition licence (PAL and POL) or other firearm certificate or registration to Constable Jeremy Pearson, or his designate with 24 hours of his release from custody;
Shall present himself at the door of his residence upon request of the police at any time when he is required to be at his residence;
Shall carry a copy of his recognizance of bail on his person at all times when out of his residence and present it to the police upon request; and
Shall provide a letter from surety to Constable Jeremy Pearson within 24 hours of your release from custody, confirming that all firearms have been removed from 103 Back Street Rd., Fort William First Nation, Ont. and to whom they were provided;
Shall attend court as required.
