COURT FILE NO.: 15-4028-SR
DATE: 2016-02-26
SUPERIOR COURT OF JUSTICE - ONTARIO
RE: ALONZO ROBIN SMITH, Applicant
AND:
KARTHI THEVENDRANATHAN, DONNA PANNUCIO and THE ATTORNEY-GENERAL OF CANADA, Respondents
BEFORE: The Honourable Mr. Justice D.A. Broad
COUNSEL: Applicant self-represented
Derek Edwards and Andrew Kinoshita, for the Respondents
Costs ENDORSEMENT
[1] The respondent Attorney General of Canada has delivered its submissions with respect to costs as directed in my Endorsement released January 21, 2016. The applicant has not delivered any submissions on costs.
[2] The Attorney General of Canada presented a Bill of Costs setting forth partial indemnity costs totalling $21,112.00, comprised of fees in the sum of $20,624.72 and disbursements of $487.28. The Attorney General has limited it request for costs to the sum of $1,000.00, inclusive of fees and disbursements, taking into account the applicant’s circumstances and the fact that he is self-represented.
[3] It is evident, from the absence of any submissions from the applicant, that he is unopposed to an award of costs against him in the reduced amount of $1,000.00.
[4] It is therefore ordered that the applicant pay to the Attorney General of Canada costs fixed in the sum of $1,000.00, all inclusive. This amount is to be paid within 30 days hereof.
D.A. Broad J.
