RE: ASSESSMENT OF DAMAGES
THE HONOURABLE MR. JUSTICE D.J. GORDON
[1] In my reasons for decision, released December 16, 2015 (2015 ONSC 7613), I awarded damages to the plaintiff for $35,000 for delayed diagnosis. I rejected her claims pertaining to informed consent and surgical negligence.
[2] Counsel for the plaintiff has requested an assessment of damages had there been success on all claims.
[3] The evidence was reviewed in my prior decision. Accordingly, had the plaintiff succeeded on all of the issues I would have assessed damages as follows:
(a) pain and suffering; $100,000.00
(b) loss of income; $100,000.00
(c) future loss of income (to age 65); $125,000.00
(d) Ministry of Health subrogated claim; and
(e) prejudgment interest.
