COSTS ENDORSEMENT
[1] Further to my endorsement of December 18, 2015, I have received costs submissions on behalf of the Plaintiff. No costs submissions were delivered by Mr. Sharma, who is self-represented.
[2] The Plaintiff seeks its costs on a substantial indemnity basis in an amount of $5,067.64, inclusive of disbursements and applicable taxes, or on a partial indemnity basis in the amount of $3,500.33.
[3] Two attendances in court were required to deal with this motion. The Plaintiff was ultimately entirely successful in the result. In my opinion, costs should follow the event in this case.
[4] In all of the circumstances, and considering the amount at issue and the straightforward nature of the argument, I am of the view that the Plaintiff should recover costs on a partial indemnity basis. I fix those costs at $2,500.00. Accordingly, Mr. Sharma shall pay the sum of $2,500.00 to the Plaintiff for costs within 60 days of the date of this order.
