[1] The respondent seeks cost of $2,500 as a result of a motion to vary an existing order for child support and spousal expenses.
[2] The applicant submits that there should be no order for costs as she was successful in the recovery of special expenses for orthodontic work and therefore success was divided.
[3] At the motion, the parties agreed on most items except for the special expenses for orthodontic work, an issue on which the applicant was successful.
[4] The applicant is ordered to pay costs of $1000 as success was divided but the respondent was successful in having the order varied. The costs owing shall be deducted from the arrears of child support owing by the respondent to the applicant.
