REASONS FOR DECISION - COSTS
[1] The Respondent Giuseppe Mastrogiacomo brought a motion to change the support orders made in this matrimonial proceeding. The Applicant Andreina Diciaula brought a motion to strike Mr. Mastrogiacomo’s motion. Her motion was successful; see Diciaula v. Mastrogiacomo, 2014 ONSC 6196.
[2] Ms. Diciaula now seeks her costs for her successful motion to strike. She seeks full recovery in the amount of $11,719.07 as particularized in her bill of costs. She made submissions in writing to support this claim for costs.
[3] Mr. Mastrogiacomo did not deliver any submissions in writing, and thus Ms. Diciaula’s request for costs is unopposed.
[4] I have reviewed the bill of costs and it is fair and reasonable.
[5] Accordingly, I grant costs as requested, payable within 30 days of the release of these Reasons for Decision.
