[2] For all the reasons previously addressed the Counterclaim is dismissed.

[3] The Plaintiff shall have prejudgment interest at the Courts of Justice Act rate calculated pursuant to sections 127 and 128 from January 30, 2010.

[4] The Plaintiff shall have post-judgment interest at the Courts of Justice Act rate calculated pursuant to sections 127 and 129.
