DECISION ON COSTS
WILCOX, J.
[1] This matter involved two motions, the Applicant father’s for interim interim access to the child, and the Respondent mother’s for sole custody of and support for the child. These were heard and an oral decision rendered on August 14, 2014. The Applicant was successful in obtaining interim interim access. There was insufficient information on which to base a child support order, but the court ordered production of that for an upcoming settlement conference. The court found that it was not appropriate to deal with custody at that time. Written costs submissions were invited and have been received and reviewed. I note that the Applicant attempted to serve an offer to settle on the Respondent on August 8, 2014 by email, but was unsuccessful apparently due to problems with the Respondent’s email. Such problems were addressed during the motion, and provision was made in the order to try to overcome them for the future. The decision on the motion regarding access fell short of the offer in the minimum duration of the visits, but otherwise was quite similar. Overall, success was mixed.
[2] I have taken into account the factors enumerated under family law rule 24 including the time spent, the result achieved, and the complexity of the matters.
[3] I conclude that each party shall bear its own costs of these motions.
