ENDORSEMENT
[1] Counsel have attended before me in connection with the decision of this court released on September 19, 2014, whereby the accused were ordered to be released on the same basis as outlined in the previous order of the justice of the peace as modified at paragraphs 26-28 in the reasons of this court.
[2] The court has been informed by counsel that there has been a change of circumstances which necessitate a further change to the modifications made by this court. Although the nature of the change of circumstances has not been fully articulated for what I consider to be sufficient reason I am satisfied that the changes proposed are necessary in the public interest.
[3] With respect to the accused Muhammed in paragraph 26(1) the condition is changed to:
- Inform the officer in charge of the address at which the accused will reside with surety or sureties and be amenable to the rules and routine of the household.
[4] With respect to the accused Saleh in paragraph 27(1) that condition is changed to:
- Inform the officer in charge of the address at which the accused will reside with surety or sureties and be amenable to the rules and routine of the household.
[5] With respect to the accused Sadat paragraph 28 will be modified by adding the following:
With respect to condition 1 in the existing recognizance that condition will be vacated and the following added:
- Inform the officer in charge of the address at which the accused will reside with surety or sureties and be amenable to the rules and routine of the household.
[6] Also the existing condition that the accused remain in Ontario will be deleted.
[7] I also order that the addresses of the sureties are not be publicly revealed subject to further order of the court.
