[1] Further to my judgment released on September 8, 2014 there was one other issue that I meant to address.

[2] The defendant submitted that this action was barred by the Limitations Act, 2002. However, the combined effect of s. 24(5) of that Act and sections 45(1) and 50(1) of the predecessor Limitations Act, R.S.O. 1990 is that this action was not statue barred.
