REASONS FOR DECISION - COSTS
[1]
Background
The Defendants, the Congregation of the Most Holy Redeemer and St. Patrick's Church, brought a summary judgment motion to have Elaine Landrie’s slip and fall personal injury action dismissed as statute-barred.
2Although she did not bring a cross-motion for summary judgment, I granted Ms. Landrie a partial summary judgment, dismissing the Defendants’ limitation period defence. I ordered that her action should proceed to trial on the issues of whether the Defendants are negligent and, if so, what is the quantification of her claim for damages.
[3]
Costs
Ms. Landrie seeks partial indemnity costs of $6,168.71 for her success on the summary judgment motion.
4The Defendants’ only objection to the costs award is their bald assertion that the amount claimed is excessive and unreasonable.
5There is no substance to this objection and I, therefore, award Ms. Landrie the costs as claimed.
6Order accordingly.
