REASONS FOR DECISION - COSTS
[1] The Defendants, the Congregation of the Most Holy Redeemer and St. Patrick's Church, brought a summary judgment motion to have Elaine Landrie’s slip and fall personal injury action dismissed as statute-barred.
[2] Although she did not bring a cross-motion for summary judgment, I granted Ms. Landrie a partial summary judgment, dismissing the Defendants’ limitation period defence. I ordered that her action should proceed to trial on the issues of whether the Defendants are negligent and, if so, what is the quantification of her claim for damages.
[3] Ms. Landrie seeks partial indemnity costs of $6,168.71 for her success on the summary judgment motion.
[4] The Defendants’ only objection to the costs award is their bald assertion that the amount claimed is excessive and unreasonable.
[5] There is no substance to this objection and I, therefore, award Ms. Landrie the costs as claimed.
[6] Order accordingly.
