COST ENDORSEMENT
[1] The defendants were unsuccessful on their motion to set aside their noting in default. In my May 27, 2014 endorsement I ordered that, with respect to costs, submissions be made within 15 days.
[2] Cost submissions were only delivered by the plaintiff who seeks costs on a substantial indemnity basis in the amount of $6,796.95 inclusive of fees and H.S.T. No amount is claimed for disbursements.
[3] I am not persuaded to award costs at the level claimed. I will allow costs on a partial indemnity scale of $4,570.00 plus H.S.T., for a total of $5,164.10 payable by the defendants, Totalsiteworks Inc., Totalsiteworks Consulting Inc., 2026751 Ontario Limited o/a Totalsiteworks Management, and Pauline Vavoulis c.o.b. as Totalsiteworks Management, to the plaintiff.
