[1] The trial in this matter took place over a period of four days. The respondent was successful in that she was granted periodic and lump sum support.
[2] Cost submissions were received only for the respondent who is claiming costs on a substantial indemnity basis in the amount of $13,104.60, inclusive of fees, disbursements and taxes.
[3] As the successful party, the respondent is entitled to costs, but I will award costs on a partial indemnity basis. There were no offers of settlement filed and the applicant’s conduct was not such as to warrant the higher scale.
[4] I accept the respondent’s bill of costs as a representation of the time spent on the file.
[5] I order that the applicant is to pay costs to the respondent in the amount of $9,714.60, broken down as follows:
Fees, on a partial indemnity basis $8,000.00
HST on fees 1,040.00
Disbursements 620.00
HST on taxable disbursements 54.60
Total $9,714.60
