CASE CONFERENCE ENDORSEMENT
[1] Following the last case conference herein dated June 20, 2014, the court reserved August 6, 2014 for argument of the plaintiffs’ anticipated motion for summary judgment.
[2] Counsel for the defendants by letter dated July 7, 2014 advised the court and opposing counsel of their objection to the bringing of the above motion, the date of August 6, 2014 for argument thereof, their need to bring one or more cross-motions and that any summary judgment decision would likely result in an appeal thereof. The plaintiffs by correspondence opposed the objections raised by the defendants as to their anticipated motion for summary judgment.
[3] The court convened this case conference to determine whether the scheduled summary judgment motion would be proceeding in light of the above objections.
[4] Upon commencement of this case conference, the plaintiffs advised they would not proceed with their motion for summary judgment in light of the objections raised by the defendants.
[5] In response to a question from counsel, the court advised that Kane J. was to be the presiding judge in the trial of this action scheduled to commence September 8, 2014.
[6] Counsel for the plaintiffs and CCC 396 advised they had no objection to Kane J. presiding as the trial judge. Counsel for the defendants advised he would seek instructions on the point and thereupon advise the court and the parties accordingly.
