ENDORSEMENT
[1] Further to my Judgment released May 29, 2014, I found six months to be reasonable notice for termination; and given that I did not have sufficient detailed evidence at trial, requested that counsel calculate:
a. the precise amount of damages for wrongful dismissal based on six months pay in lieu of reasonable notice of dismissal and severance pay, less the income earned as of September, 2009 at RBR;
b. the amount of damages for loss of pension contributions during the six month reasonable notice period; and
c. the amount of pre and post-judgment.
[2] The calculations were to be submitted to me by June 13, 2014. That did not happen and now counsel request time to argue the calculation of damages. There is not time available within a reasonable time-frame for both counsel and the Court. Therefore, counsel are to provide written submissions on that issue as follows: counsel for Mr. Vist by July 7, 2014 followed by counsel for Best Theratronics Ltd. by July 21, 2014; with any reply submission by counsel for Mr. Vist by August 1, 2014.
[3] The submissions are to be no more than five pages in length and are to include reference to any relevant case law. Books of authorities may be provided.
