Endorsement
[1] The Respondent has objected to paragraphs 15, 16 and 18 of the draft order prepared by the Applicant relation to the Court’s Reasons for Decision dated April 23, 2014. The balance of the order will be taken out by the Applicant.
[2] The Respondent has filed a Notice Disputing the Order dated May 15, 2014.
[3] This Court orders that the Respondent bring a motion to the Court in accordance with Rule 25(19) of the Family Law Rules before Kershman, J. on July 22, 2014 at 9:00 a.m. The motion will relate to the aforesaid relief only. Any other contemplated motion will not be heard on that date. Each party will have no more than 20 minutes to argue their respective positions.
[4] The Respondent will include his SSAG calculations with his motion materials. The Court already has the Applicant’s SSAG calculations, however if the Applicant wishes to provide new set calculations she can do so.
[5] The Respondent shall serve his motion materials no later than June 23, 2014. The Applicant shall serve her responding materials no later than June 30, 2014.
[6] The Respondent shall serve any reply materials no later than July 3, 2014.
[7] Any cross-examinations on affidavits shall be completed by both parties no later than July 11, 2014.
[8] Undertaking shall be satisfied no later than July 17, 2014.
[9] In the interim, the Court directs that the Respondent shall forthwith pay the sum of $24,000 in spousal support arrears and a further $5,000 on July 1, 2014. These amounts will be taken into consideration when determining the actual monthly amount of spousal support and arrears. The aforesaid amount takes into consideration the credit of $12,350.50, as set out at paragraph 30 and 71 of the Reasons for Decision dated April 23, 2014. Non-payment of these amounts as required will be taken into consideration when determining the issue of costs of the Motion and the time in settling the Order.
[10] In the event that the parties are unable to approve the order relating to this endorsement as to form and content, the order pursuant to this endorsement shall be settled on June 24, 2014 at 4:30 p.m.
[11] Order accordingly.
