ENDORSEMENT (re: Costs of Certification Motion)
[1] In Reasons for Decision released May 20, 2014, I declined to certify this action as a class proceeding. I stated that cost submissions could be made if the parties were unable to agree on costs. The Crown filed its cost submissions on June 9, 2014.
[2] By letter dated June 11, 2014, Ms. Chaudhury, counsel for the Law Foundation of Ontario (“LFO”), advised me that the plaintiffs had received funding from the LFO for the proposed class action and that the LFO had indemnified the plaintiffs for costs orders made against them.
[3] Ms. Chaudhury further advised that the parties and the LFO have agreed that the costs of the certification motion shall be payable to the defendant forthwith in the amount of $50,000, inclusive of all taxes and disbursements, and that the parties request that the court issue an endorsement reflecting their agreement.
[4] Accordingly, on consent of the parties and the LFO, costs of the certification motion are payable to The Attorney General of Canada forthwith in the amount of $50,000, inclusive of all taxes and disbursements.
