REASONS FOR DECISION - COSTS
[1] In this action, Xiao Jun Huang sued Yin Song Mai and Xiong Wang Chen in a personal injury action arising from a collision between a bicycle, which was being ridden by Ms. Huang, and a motor vehicle, which was being driven by Ms. Mai.
[2] Ms. Mai and Mr. Chen, who was the owner of the vehicle, brought a summary judgment motion to dismiss the action on the ground that it is statute-barred under the Limitations Act, 2002, S.O. 2002, c. 24, Sched B. Ms. Huang resisted the summary judgment motion and brought a cross-motion to amend her Statement of Claim.
[3] I dismissed the Defendants’ summary judgment motion and I granted Ms. Huang’s motion to amend her Statement of Claim. See Huang v. Mai, 2014 ONSC 1156.
[4] In my Reasons for Decision, I stated that if the parties cannot agree about the matter of costs, they may make submissions in writing beginning with Ms. Huang’s submissions within twenty days of the release of the Reasons for Decision followed by Ms. Mai’s and Mr. Chen’s submissions within a further twenty days.
[5] I received written submissions from Ms. Huang but none from Ms. Mai and Mr. Chen.
[6] Ms. Huang submitted a Cost Outline, and she seeks $5,155.26 all inclusive.
[7] Ms. Huang’s claim for costs is unopposed and in my opinion, it should be granted as requested.
[8] Order accordingly.
