ENDORSEMENT
1Further to my judgment dated January 8, 2014, I want to add the following:

Child Support
The applicant’s claim for support for the parties’ adult child Robert, born June 9, 1993, is dismissed.
3I was not persuaded on the evidence that Robert was a child within the meaning of the Divorce Act. Further, the respondent does not have the means to pay support.

Costs
With respect to costs, success was divided. While the respondent was successful with respect to spousal support, both lump sum and periodic, she was unsuccessful with regards to her position on the date of separation, and whether the limitation period for the equalization claim, ought to be extended. As a result of the latter, the respondent’s claim for equalization was dismissed.
5As noted above, the applicant’s claim for child support was dismissed.
6The applicant represented himself at the trial, while the respondent had counsel, Mr. A. Misir. Counsel has provided me with a bill of costs claiming 66.5 hours at $350.00, which was inclusive of the four days of trial. I take no issue with regards to the quantity of this account.
7No offers of settlement have been provided to me.
8Given the divided success, I will not award costs and state “There shall be no order as to Costs.”
