[1] On November 29, 2013, I sentenced Mr. Durette to a period of imprisonment and ordered forfeit $730.00 cash money, a cell phone and a 2005 GMC Safari motor vehicle pursuant to s. 16 of the CDSA. The offender contested only the forfeiture of his vehicle. At that time, I indicated that formal reason for that specific disposition would follow in due course. These are those reasons.
[2] I find the circumstances in the instant case to be virtually identical to those prevailing in R.v. Gagnon, 2009 QCCA 1667 which I find to be persuasive. In the result, Mr. Durette’s vehicle was ordered forfeit.
